O juiz Sivanildo Torres Ferreira, do Tribunal Regional Eleitoral da Paraíba (TRE-PB), determinou, na noite desta terça-feira (1°), a retirada da tornozeleira eletrônica da primeira-dama de João Pessoa, Lauremília Lucena, imposta pela juíza Maria Fátima Ramalho, da 64ª Zona Eleitoral de João Pessoa, ao converter sua prisão preventiva em medidas cautelares.
O uso estava entre as medidas cautelares imposta pela magistrada, que foi derrubado na nova decisão. “Da leitura dos autos, verifica-se que a decisão atacada não se deteve no exame da gravidade do crime, das circunstâncias do fato e das condições pessoais da paciente, impõe-se, na minha ótica, a não aplicação da medida de monitoramento eletrônico à pacient”, diz trecho.
“Até mesmo pela ausência de uma motivação fundada em evidências concretas da sua efetiva necessidade no caso concreto”, escreveu o magistrado na decisão.
