O julgamento do Tribunal Superior Eleitoral do pedido do PSDB de impugnação da candidatura de Dilma Rousseff para presidência deve ser finalizado entre seis e dez meses. Caso seja cassada, o vice Michel Temer vai junto — não existe possibilidade de separação nesse caso, algo que teria sido aventado por membros do PMDB. As afirmações são do ministro Dias Toffoli, do Supremo Tribunal Federal e presidente do TSE, em entrevista ao programa Canal Livre, veiculado pela Rede Bandeirantes neste domingo (8/11). A conversa ainda rendeu uma alfinetada em um colega de Supremo.
Toffoli garantiu que o TSE tem competência para cassar um mandato, ao contrário do que disse o jurista Dalmo Dallari em parecer divulgado na imprensa. “Temos um poder constitucional de cassar mandatos, como já fizemos com prefeitos, governadores e senadores. Aquilo não é um parecer, é um ‘acho que’, não teve embasamento, e o autor está equivocado”, disse o ministro. Ele ainda adiantou: não existe a possibilidade de separar a chapa e, em caso de impedimento, o vice também deixa o cargo.
O ministro afirmou que não foi ele quem escolheu a relatora do julgamento, Maria Thereza de Assis Moura (“é um sorteio feito pelo computador entre uma lista”), e indicou que, se a decisão fosse sua, seria diferente (“juiz não tem desejo, mas, se tivesse, esse talvez não seria o meu”). A polêmica em torno da escolha da relatora se deu porque, inicialmente, a juíza se posicionou contra a abertura de inquérito— ela foi voto vencido no TSE, que decidiu pela abertura do processo.
